These Terms of Use ("Terms") govern your use of the NEPA application and the hospitals.care website (the "Service"), provided by SMB Operations Inc. ("we," "us"). By using the Service, you agree to these Terms.
The Service
NEPA is an inpatient companion offered to patients through participating hospitals. It lets you set meal preferences, submit a daily check-in (pain, sleep, appetite, and comfort), and share confidential feedback during your hospital stay.
Not for emergencies; not medical advice
The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not monitored in real time and must not be used for urgent or emergency needs. For anything urgent, use your nurse call button, contact your care team directly, or dial 911 (or your local emergency number). Check-ins are reviewed by clinical staff only during routine rounds.
Eligibility and accounts
You access the Service through an invitation associated with your hospital stay. You are responsible for keeping your account credentials secure and for activity under your account. Notify your hospital or us if you suspect unauthorized use.
Acceptable use
- Provide accurate information and use the Service only for its intended purpose.
- Do not misuse, disrupt, probe, or attempt to gain unauthorized access to the Service.
- Do not submit unlawful, harmful, or infringing content.
Privacy
Your use of the Service is also governed by our Privacy Policy and your hospital's privacy practices.
Intellectual property
The Service, including NEPA and its software, content, and trademarks, is owned by SMB Operations Inc. or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, SMB Operations Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
Changes to the Service and Terms
We may modify or discontinue the Service and may update these Terms. Material changes are indicated by the "last updated" date above; continued use means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in Ontario, Canada have jurisdiction over disputes arising from these Terms, subject to applicable law.
